• 2) Schedule a Test Drive: We collect your location information, including your postcode, or your address to find a local retailer and schedule a test drive. We also collect your first name, e-mail address or phone number, as well as your selected vehicle type, your preferred method of communication and your selected dealer name and dealer address as included in the web form in order to schedule a test drive to the selected dealer. We process the aforementioned personal data to perform an agreement with you or in order to take steps at your request prior to entering into an agreement.
• 3) Submit your configuration: We collect your name, phone number or email after you submit your configuration to fulfil your request for products and services based on our contract with you. We process aforementioned personal data on the basis of the performance of our agreement with you.
• 4) Contact Us / Submit your question or comment: We may collect any personal data you choose to provide us with in our communication to respond to your queries and provide you with your requested services or products. We collect your first and last name, phone number or your e-mail address, your region and your postcode, your selected topic, your selected contact preference type and your questions or comments to your queries. For this purpose, we process your above personal data for the purposes of the legitimate interests of BYD Europe in responding to your questions and comments.
• 5) Newsletter subscriptions and advertising: We may collect your e-mail address, name, phone number and vehicle purchasing preferences, if applicable, in order to provide you with a service and/or inform you about our (new) products, events and services. For this purpose, we process your personal data on the basis of your consent and/or legitimate interest (as applicable). If you no longer want to receive promotional-related emails, you may opt out of receiving them by clicking the unsubscribe button in your mails, and/or object to the processing of your personal data for advertising purposes by informing our Data Protection Team at privacy.eu@byd.com. Please note that we may still send you safety messages or product service issues even if you opt out of receiving marketing messages.
• 6) On site: We and/or our dealers may collect process the following (personal) data from or about you offline below, when you visit a BYD store/dealer store or BYD service facility, request after-sale services, attend one of our events, sign up for a test drive, receive offline after-sales services or sign a purchase contract with us.
· Your basic information: your name, plate number.
· Contact information: your address, phone number, email address.
· Vehicle information: vehicle identification number (VIN), user ID, vehicle plate number, vehicle model, hardware ID, vehicle telematics log data, repair history, etc.
· Purchase information: purchase date, delivery status.
The legal basis which we rely on for such processing is on the basis of the perform a contract/ agreement between you and us or with your consent or legitimate interest.

If we have a relationship with you, as a customer of BYD vehicles, we generally hold your personal data for 7 years from the end of the calendar year in which our contractual relationship ends, unless we are required or allowed to retain such data longer as mentioned above, or as needed to establish, bring or defend legal claims.
Where we have obtained your personal data following a request for information, test drive or any other information on any of our products or services, we hold your personal data for 1 year and 6 months from the date we collect that information, unless during that period we establish a relationship with you.
BYD has put in place robust technical and organizational measures for the protection of your data in accordance with the current, general state of technology, especially to protect the data against loss, falsification or access by unauthorized third persons. Once we have received your personal data, we will use strict procedures and security features to prevent unauthorized access. However, the transmission of information via the internet is not completely secure. So, whilst we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted via our website. In the unfortunate event that a personal data security incident occurs, we will report it and take remedial measures – both if and as required under applicable law and from regulatory authorities.
We share the information identified above:

o BYD Europe and BYD dealers are separate legal entities with their own privacy policy. Please be aware that each dealer operates as a separate legal entity and you should read the dealer’s privacy policy to ensure that you understand its privacy policies and procedures. Additionally, because the BYD dealer often is the first contact with you, the dealer can answer any questions you may have about its privacy policy. While BYD Europe encourages its dealers to ensure full compliance with all applicable privacy legislation and has provided information to our dealers relating to privacy obligations, BYD Europe is not responsible for dealers’ compliance with applicable law.
· 3) with our suppliers and service providers, agents, subcontractors and other organisations for the purposes of providing services to us or directly to you on our behalf. Such third parties may include cloud services providers (such as hosting and email management) or other third parties who provide services to us. When we use third party service providers, we only share with them the personal data that is necessary for them to provide their services and we have a contract in place that requires them to keep your information secure and not to use it other than in accordance with our specific instructions.
